These conditions shall apply to the sale of products by CILAO.COM at the company's on-line store. The buyer can view these conditions on the “Order” page of the Cilao.com web site. When the buyer places an order, he/she declares his/her implicit and unconditional acceptance of these General Purchasing Conditions in their entirety.

ARTICLE 1- PRICE

1.1  – The prices for our products are stated in euros inclusive of all taxes but exclusive of handling and shipping costs.

1.2 – All orders irrespective of where placed are payable in Euros.

1.3 – CILAO.COM reserves the right to change the prices indicated at any time but all products shall be invoiced at the price in force at the time the order was registered, subject to availability at that date.

1.4 – All products remain the property of CILAO.COM until payment has been received in full.

ARTICLE 3 – VALIDATION

You shall declare that you have read and that you accept these General Purchasing Conditions prior to placing your order. Validation of your order is therefore deemed confirmation of your acceptance of the General Purchasing Conditions
Except where evidence is produced to the contrary, the data recorded by Cilao.com shall constitute the evidence of all transactions between Cilao.com and its customers.

ARTICLE 4 – AVAILABILITY

The products we offer and the prices stated shall be valid for as long as they are displayed as such on the site within the limits of stocks available.

In the event that an item becomes unavailable after your order is placed, we shall inform you by e-mail or by post without delay. Your order shall be automatically cancelled and, if your bank account has been debited, you will be reimbursed immediately.

Where payment was made by cheque and all or part of the order proves to be unavailable, the relevant sum shall be reimbursed either by cheque or by credit to the customer's account, at the discretion of Cilao.com, within thirty days from the date of payment by the customer.

ARTICLE 5 – DELIVERY

5.1 – Miscellaneous points
Products purchased at Cilao.com shall be delivered to the delivery address indicated by you when placing the order. Where delivery dates vary for certain items according to their availability, the lead time is based on time stated for the item requiring the longest period for delivery. Cilao.com however reserves the right to split deliveries. The contribution to handling and shipping costs is charged for one shipment only. Cilao.com cannot be held responsible for the consequences of delay of any shipment.
In the event of delay, an e-mail will be sent to you. In this event and as long as the item has not been dispatched, you have the right to cancel your order.

5.2 –Problems concerning items delivered
Please notify the carrier and Cilao.com of any reservations you may have concerning the items delivered (e.g. : package damaged, open on arrival etc.) within 3 days of receipt of the item. Then, in accordance with the cases defined in article

5.3 below , you may take advantage of the conditions of exchange or reimbursement as set down in this article.

5.4 – Conformity of products
We undertake to reimburse or to exchange any defective product or products or those that do not conform to your order. In such a case, we would appreciate your returning the products to us with a detailed written explanation. Cilao.com will then, according to your preference, exchange the product or products or provide a full reimbursement. The request must be made within seven days of delivery. We cannot accept any claim received after this time. The items must be returned to us in the condition in which you received them, complete with all the elements supplied (accessories, packaging, instructions etc.).

ARTICLE 6 – PAYMENT

Payment for your purchases shall be made :
- either by credit/debit card: Visa, MasterCard, carte bleue. Service supplied by Crédit Agricole.

ARTICLE 7 – REIMBOURSEMENT

Reimbursement in the cases set down in articles 5 and 8 shall be made within a maximum of 15 days from the date the products are received by us.
Reimbursement shall be effected either by a credit to your bank account or by cheque made out to the customer who placed the order and sent to the address on the invoice.
No shipment received cash-on-delivery may be returned whatever the reason.

ARTICLE 8 – SATISFACTION OR MONEY-BACK

You have 7 days from the date of receipt to return any item that is unsuitable. You are responsible for all shipping costs in this case. Only the purchase price of the product or products shall be reimbursed. This right to return goods can only be exercised for items returned in their original packaging, complete (accessories, instructions etc.), in good condition and accompanied by a copy of the purchase invoice. Items returned incomplete, damaged, corrupted or soiled by the customer will not be accepted.

The products offered for sale conform to current French legislation and the standards currently in force in France . Cilao.com cannot be held liable in the event that its products do not confirm to the legislation in force in the country to which the product is shipped (in the event, for example, of a ban on a certain product …). It remains the responsibility of the buyer to check with the authorities in the country where the product is to be shipped in respect of importation and utilisation of the products and/or services the buyer may wish to order.

Only in the event of a blatant misrepresentation of the product's characteristics and/or the conditions of sale can Cilao.com be deemed liable.

Where items are purchased for professional use, Cilao.com shall not be liable for any indirect damages resulting from these presents, operating losses, loss of profits, damages or expenses arising from the purchase of the products etc. The performance of our products is compatible with that required for professional utilisation. Cilao.com cannot therefore be held liable for any losses resulting from a professional activity.

ARTICLE 12 - GUARANTEE

In order to benefit under the terms of the product guarantee, it is essential to retain the purchase invoice for the product.
The contractual guarantees do not cover :

- abnormal use or inappropriate use of the products. In this respect, we suggest that you read carefully the instructions for use of the product,

- faults and the consequences thereof associated with inappropriate use of the product or a utilisation not intended for the product (professional, collective utilisation...),

- faults and the consequences thereof linked to external causes.

In any event, you shall benefit from the statutory guarantees notably those relating to guarantee against latent defects.

ARTICLE 13 – APPLICABLE LAW - DISPUTES

This agreement shall be subject to French law. The language of this agreement is French. In the event of any dispute, the sole venue shall be the court at ANNECY .
